EL PASO, TX (KTSM) - A 22-year-old man who was detained by U.S. Border Patrol in early March during a routine traffic stop was released over the weekend, but is still facing removal proceedings.
Jesus Vasquez was pulled over March 4, during a traffic stop in the Montana Vista area after Texas DPS Troopers say he failed to use a turn signal and had improperly tinted windows.
While asking for his identification, Vasquez was unable to provide a driver's license. According to Vasquez's attorney, Carlos Spector, Texas DPS Troopers violated his rights by performing an unlawful search and seizure of his vehicle which uncovered his Mexican birth certificate in the glove compartment.
According to DPS, Vasquez handed troopers his birth certificate when they asked him for his drivers license.
Vasquez argues that he's been pulled over in the past, but was only given tickets for not having a license and insurance instead of being asked for his legal status. He has no criminal history in El Paso County.
