EL PASO, Texas (KTSM) - *This story has been updated.

El Paso Police say they've arrested 27-year-old Rodrigo Rodriguez for the murder of 26-year-old Ruby Rodriguez in El Paso's Lower Valley early Monday morning.

According to police, they were called to a welfare check just after 3 a.m. in the 300 block of Apodaca Pl. in the Lower Valley Monday morning. When they arrived, they found Ruby Rodriguez's lifeless body inside of the home.

Investigators with EPPD's Crimes Against Persons Unit learned that her husband, Rodrigo Rodriguez got into a fight with Ruby and stabbed her.

He then allegedly fled the scene and was eventually located by the Department of Public Safety (DPS) air support around 7:30 a.m. in the canal/irrigation area close to S. Americas Ave., and Southside Rd. near South Loop Elementary.

Initially, EPPD identified the couple as married, however-- Ruby Rodriguez's brother reached out to NewsChannel 9 stating that although the two had the same last name, they were not married. Richard Rodriguez, Ruby's brother, claimed that the pair had a daughter together and that Ruby had gone to the home to pick  up the girl prior to her death but the two were no longer a couple.

He claims that Rodrigo Rodriguez had taken the girl to another home before Ruby arrived and she was not home and was uninjured.

According to court documents obtained by NewsChannel 9, Rodrigo Rodriguez was indicted in March for Assault on a Household Member w/Previous Conviction stemming from a December 18, 2016 incident with Ruby. The court documents indicate that the two were involved in a fight where Rodrigo allegedly closed a door and injured Ruby.

He was arrested for the incident just ten days prior to Ruby's death, on April 14, 2017 and released the same day.

Rodrigo Rodriguez was taken into custody and booked into the El Paso County Detention Facility on Murder Charges. This is the 9th murder of 2017.

Ruby Rodriguez was a 2009 graduate of Bel Air High school, she leaves behind two young daughters. If you would like to help the family with funeral expenses, you can do so on a GoFundMe page set up by CLICKING HERE.
