El Paso, TX - An arrest affidavit obtained by NewsChannel 9 Thursday regarding the alleged sexual assault of a child under 17-years-old in Horizon earlier this week sheds new light into the events leading up to the alleged assault and stabbing of the suspect.
According to court documents, 20-year-old Joseph Hernandez was a friend of the victim's family who was visiting the area from California for Christmas. The victim, identified as a 17-year-old girl, and her older sister, both went upstairs to go to sleep on Sunday night.
The victim claims that at some point after her and her sister had fallen asleep, she woke up when she felt a hand go under her shorts and underwear and began touching her. She said she turned around and saw Hernandez in bed with her, though he was acting as he was asleep.
She told police that she moved away from him, fearing that he'd touch her again. Later, she did feel him grab her inappropriately once again. She immediately got up go to the kitchen and grab a knife.
She said when she returned to the room, she saw Hernandez laying behind her older sister. She told police that she feared Hernandez would try and touch her sister also, so she stabbed him about five times - four in the arm and one in the back.
Hernandez was taken to an area hospital for injuries and the victim was also taken to the hospital for a sexual assault evaluation.
During the subsequent interview, the victim and her sister both told investigators that Hernandez had touched them inappropriately. The older sister said that she thought she was having a bad dream about being touched until she woke up and realized it wasn't a dream.
It wasn't until her younger sister began stabbing Hernandez and he started screaming "she's stabbing me" that the older sister fully woke up.
Hernandez was charged with Sexual Assault of a Child under the Age of 17 and booked into the El Paso County Detention Center.
