Man arrested on charges of violent sexual assault, kidnapping

LAS CRUCES, NM (KTSM) - A Las Cruces man accused in the violent attack, kidnapping and sexual assault his ex-girlfriend in a daylong ordeal Monday is now behind bars.

Benjamin T. Hampton, 35, is charged with several counts, including criminal sexual penetration and aggravated battery against a household member.

According to investigators, Las Cruces police were called to the 2400 block of Espina around 1 a.m. Tuesday morning after a woman called from a neighbors home saying she'd been held against her will and raped by an ex-boyfriend while her young children were home.

The woman told police that Hampton came to her home early Monday morning and became confrontational with her when she questioned him about some missing medications. During the assault, he allegedly threw her to the ground and strangled her until she lost consciousness.

Following the physical assault, police say they believe Hampton ripped the woman's clothes off and bound her wrists and ankles with duct tape. He's accused of sexual assault and threatening to hold her for several days.

Around 5 p.m. Monday evening, Hampton reportedly removed the duct tape and allowed the victim to get dressed, according to reports. Just after midnight Tuesday morning, the woman asked Hampton if she could walk outside to smoke.

The victim told police that instead of walking outside to smoke, she ran to a neighbor's home for help.

Responding officers took Hampton into custody and booked him into the Doña Ana County Detention Center, where he is being held without bond.

The victim and her two young children were not seriously injured in the incident.
